An Overview

There are many times when Medicare will not cover specific physical therapy interventions, whether because of statutory limitations (such as exceeding the Therapy Cap or providing prevention and wellness services) or when services are not deemed medically necessary. Often, physical therapists will discharge patients, patients will stop coming to therapy, or services are provided for free, even though providing Medicare patients with free services may in fact violate the federal anti-kickback statute. There are legal pitfalls that providers must be aware of related to charging patients cash, or if considering providing free or reduced cost services to Medicare beneficiaries. This audio conference will review the instances in which Medicare will not cover physical therapy services, identify when therapists can charge patients directly for these services, and under what conditions this can occur. Ensure that you and your therapists are appropriately identifying revenue opportunities that may exist beyond situations in which Medicare will provide payment, so that the full spectrum of physical therapist services can be provided to patients who wish to receive and pay for them!

Upon Completion, you and your staff will:

t Understand what/when services are not considered skilled or medically necessary based on Medicare’s rules and requirements;
t Learn when and what types of services may be billed directly to Medicare beneficiaries, and under what circumstances;
t Learn how to utilize the Advanced Beneficiary Notice (ABN) to inform patients that Medicare will likely deny payment and that the patient will be financially responsible should they wish to receive certain therapy services;
t Ensure services are not being given away for free (and potentially in violation of the federal anti- kickback statue) when there is an opportunity to capture cash-based revenue for physical therapy, so that revenue opportunities are not being “left on the table”, and
t Become aware of some of the legal issues surrounding providing free or reduced fee services or offering in-network benefits when patients see out-of-network providers.
